Three years ago, even President Obama would have agreed with Judge Vinson's decision. In arguing against the idea of an individual mandate in government-run health insurance, President Obama said in 2008, "If a mandate was the solution, we can try to solve homelessness by mandating everybody to buy a house."

Obama's quote demonstrates the ludicrousness of the federal government requiring people to buy certain products or services in order to solve what the government perceives as a problem. If the government is allowed to dictate commercial behavior by forcing citizens to purchase things they don't want to purchase, then it won't be long before Washington starts forcing everybody to buy a U.S.-made automobile each year to support the auto industry... or pharmaceuticals, vaccines, and other products and services the government wants to push onto the people.

    "Congress could require that everyone above a certain income threshold buy a General Motors automobile -- now partially government-owned -- because those who do not buy GM cars (or those who buy foreign cars) are adversely impacting commerce and a taxpayer-subsidized business."

    In a demonstration of the ridiculousness of governments forcing citizens to buy things, five South Dakota lawmakers have introduced legislation that would require all residents of that state to buy a firearm to provide for their own self defense. (http://www.argusleader.com/article/...)

    The bill is, of course, being put forth solely to make a point: That governments have no business forcing citizens to buy things they don't personally want or even believe in.

        One Florida judge has ruled against many other federal decisions.

        Congress was within its constitutional authority to regulate interstate commerce when it included a requirement in the health care reform law that individuals purchase insurance or pay a fine, U.S. District Court Judge Gladys Kessler ruled on Tuesday.

        With this ruling, Kessler becomes the third federal district court judge to rule in favor of the law’s constitutionality.

        “Congress had a rational basis for its conclusion that the aggregate of individual decisions not to purchase health insurance substantially affects the national health insurance market,” wrote Kessler. Persons who don’t purchase insurance “will ultimately get a ’free ride’ on the backs of those Americans who have made responsible choices to provide for the illness we all must face at some point in our lives,” she added.

        The rational basis test is the least demanding of the tests to determine a law’s constitutionality. So if higher courts apply the same test, that has to be a good sign for the law’s continuation.

        There is little question among constitutional scholars that the individual mandate is in fact constitutional. The argument against, is that congress does not have the powers to dictate that every citizen must buy a commercial product. But the affordable health care law does not require that. It merely says that if any citizen buys health care insurance they will get a tax break ...if they don't they don't get the break. The incentive is not forced and anyone has the right to not buy insurance ... they will just have a higher tax bill if they don't . The desired result is there will be no freeloading on the health care system.

        This tax incentive is not surprisingly a republican idea ( they love tax breaks). Had George Bush Senior been elected to a second term, he assuredly would have proposed and signed just such a bill. He advocated and supported the concept of the individual mandate enforced by tax incentives.

        Had GHWB been re-elected we would be now be calling it "Bush Care" instead of "Obama Care".

        Actually The new healthcare Law, which will require everybody to purchase health care, and I don't care whether you have a good plan that your happy with right now...You will not be able to keep your Health Plan..By offering Lower rates in the beginning, Comrade Obama hopes to push the Big Insurance companies from the market and create a void that the Government will fill eventually cutting back services and Much needed Medications and surgeries that will only be allowed to the privilaged few..the Obama Elite and Congress..It's called Socialism or Statism or Communism or some other damned thing

        Finally, individual policies have high start-up costs. If insurers cannot spend more of their revenue getting plans on track, fewer new policies will be offered

          Gottlieb is correct... In that your old healthcare can not be kept exactly as it was.

          It will be better fairer and more equitable. Your old plan had a cap on what you could claim. Then it could throw you out without health care, even if you paid all your premiums on time. That practice ends next year.

          Your old plan threw your kids off to fend for themselves at 18. That is no longer happening.

          Under your old plan you much were more likely to die or go bankrupt if you got really sick or injured.

          I say it is a good thing that we can't keep our old plan exactly as it was in the bad ole days.

          Superior health care for the wealthy elite has been in effect for decades as the poor were left to die, that is ending with the Affordable Health care law.
